{"id":330,"date":"2015-10-05T12:28:57","date_gmt":"2015-10-05T16:28:57","guid":{"rendered":"https:\/\/nybusinesslitigator.com\/?p=330"},"modified":"2016-12-11T01:06:18","modified_gmt":"2016-12-11T06:06:18","slug":"time-barred-claims","status":"publish","type":"post","link":"https:\/\/nybusinesslitigator.com\/?p=330","title":{"rendered":"Time Barred Claims &#8211; When Is It Too Late to Sue Under GBL \u00a7349?"},"content":{"rendered":"<p>A court may dismiss a claim if parties assert\u00a0the claim\u00a0beyond the statutory\u00a0time limit.\u00a0CPLR \u00a73211(a)(5)\u00a0authorizes the Court to dismiss a cause of action on the ground that \u201ca relevant statute of limitations has expired.\u201d I recently briefed this in the context of a GBL\u00a0\u00a7349 claim for consumer deception where the claim was asserted more than 3 years after the alleged act.<em>\u00a0<\/em><!--more--><\/p>\n<blockquote><p>&nbsp;<\/p>\n<p><em>The Statute of Limitations for GBL \u00a7 349\u00a0is governed by New York CPLR \u00a7214(2). <\/em>Corsello v. Verizon New York, Inc.<em>, 18 N.Y.3d 777, 789 (2012). \u201cThat claim [, GBL \u00a7349] is subject to the three-year limitations period imposed by CPLR 214(2), which applies to actions \u2018to recover upon a liability . . . created or imposed by statute.\u2019\u201d Id.\u00a0Accrual for a claim under GBL \u00a7349\u00a0begins once a \u201cplaintiff has been injured by a deceptive act or practice violating [GBL] section 349.\u201d <\/em>Gaidon v. Guardian Life Ins.
