{"id":144,"date":"2012-03-25T19:02:24","date_gmt":"2012-03-25T23:02:24","guid":{"rendered":"https:\/\/nybusinesslitigator.com\/?p=144"},"modified":"2016-12-11T01:05:43","modified_gmt":"2016-12-11T06:05:43","slug":"unjust-enrichment-its-just-like-it-sounds","status":"publish","type":"post","link":"https:\/\/nybusinesslitigator.com\/?p=144","title":{"rendered":"Unjust Enrichment &#8211; It&#8217;s Just Like It Sounds"},"content":{"rendered":"<p>Did someone make money off of you unfairly? \u00a0You may have a cause of action (claim) for unjust enrichment. \u00a0<!--more--><\/p>\n<p>\u201cA person is unjustly enriched when retention of the benefit received would be unjust considering\u00a0the circumstances of the transfer and the relationship of the parties.\u201d <em>Hornett<\/em> v. <em>Leather<\/em>, 145 A.D.2d 814,\u00a0816 (3d Dept. 1988) (<em>citing<\/em>, <em>McGrath<\/em> v. <em>Hilding<\/em>, 41 N.Y.2d 625, 629 [1977]. \u201cIt does not require a\u00a0showing of a wrongful act by the person enriched.\u201d <em>Simonds<\/em> v. <em>Simonds<\/em>, 45 N.Y.2d 233, 242(1978).<\/p>\n<p>An action to recover for unjust enrichment rests upon the equitable principle that a person shall not\u00a0be allowed to enrich himself or herself unjustly or at the expense of another,<em> Miller v. Schloss,<\/em> 218 N.Y.\u00a0400, 407, 113 N.E. 337 (1916), and sounds in restitution or quasi-contract, <em>Edelman<\/em> v. <em>Starwood Capital\u00a0Group,<\/em> LLC, 70 A.D.3d 246, 250, 892 N.Y.S.2d 37 (1st Dept. 2009). A benefit conferred under a contract\u00a0unenforceable under the Statute of Frauds may be recovered in quasi contract if the other party is in\u00a0default, <em>Harmon<\/em> v. <em>Alfred Peats Co.,<\/em> 243 N.Y.473, 154 N.E. 314 (1926); <em>Galvin<\/em> v. <em>Prentice<\/em>, 45 N.Y. 162\u00a0(1871).<br \/>\nWhen property has been acquired in such circumstances that the holder of legal title may not in\u00a0good conscience retain the beneficial interest, equity converts him to a trustee.\u201d <em>Beatty<\/em> v. <em>Guggenheim\u00a0Exploration<\/em> <em>Co<\/em>., 225 N.Y. 380, 122 N.E. 378 (1919). \u201cA court of equity in decreeing a constructive trust\u00a0is bound by no unyielding formula.
